Crystal Austin Nutrition Pty Ltd
The IBS Accelerator – Monthly Subscription

By clicking “Buy Now,” “Join the Program,” or any similar phrase, entering your payment information, or otherwise enrolling, electronically, verbally, or otherwise, you (“Client”) agree to be provided with products, programs, or services by Crystal Austin (“Coach”), acting on behalf of Crystal Austin Nutrition Pty Ltd (“Company”). You are entering into a legally binding agreement (“Agreement”) with the Company, subject to the following terms and conditions:

1. Scope of Services
1.1 Upon execution of this Agreement, the Coach agrees to provide services as outlined in The IBS Accelerator (“Program”).
1.2 The scope of services is limited to those specified on the Company’s website or program materials.
1.3 The Company may substitute services of equal or comparable value as needed.

2. Client Responsibilities
2.1 The Client agrees to:

Actively participate in the Program.

Be solely responsible for implementing strategies and achieving outcomes.

Use Program materials for personal, non-commercial purposes only, and not share login details or materials with third parties.

2.2 The Company reserves the right to remove the Client from the Program without refund for non-compliance with these terms or disruptive behaviour.

3. Program Inclusions
The Program includes:

Access to the IBS Accelerator online portal.

Access to the private Facebook group.

One 30-minute welcome call with Crystal (valid for 1 month).

Weekly group coaching calls via Zoom.

Bonus materials including Low FODMAP recipe eBooks, meal plan bundles, expert interviews, and a 3-month subscription to the Nerva Gut Hypnotherapy app.

4. Disclaimers
4.1 The Coach and Therapist are not medical doctors. The Program is not a substitute for medical advice, diagnosis, or treatment.
4.2 Any recommendations or strategies are followed at the Client’s own risk.

5. Payment, Cancellation & Refund Policy
5.1 Subscription Model:
This is a month-to-month subscription. The Client authorises the Company to charge the provided payment method automatically every 30 days until cancelled.

5.2 Cancellation:
The Client may cancel their subscription at any time by providing written notice to crystal@thecrystalaustin.com with at least 14 days’ notice before their next billing date. Access will continue through the current paid period. No partial refunds will be issued for unused time.

5.3 No Refunds:
Due to the digital nature of the Program and immediate access to materials, no refunds are provided under any circumstances. The Client is responsible for cancelling on time to avoid further charges.

5.4 Non-Payment:
If a payment fails, access to the Program will be suspended until the account is brought up to date. If unpaid beyond seven (7) days, the Company may terminate this Agreement.

6. Waiver of Liability
The Client assumes full responsibility for participation in the Program and agrees to consult with a healthcare professional before implementing any physical or nutritional recommendations.

7. Use of Note-Taking Software
Zoom sessions may use an AI tool (“Heidi”) for enhanced documentation. Heidi is HIPAA-compliant. By participating, the Client consents to its use.

8. Intellectual Property
All Program content remains the property of the Company. The Client receives a personal, non-transferable licence for use while actively subscribed.

9. Media Release
The Client grants permission to use their likeness, voice, and testimonials for marketing. No compensation is due for this use.

10. Non-Disparagement
The Client agrees not to make any public or private statements that could damage the Company’s reputation.

11. Dispute Resolution
Disputes will be resolved through good-faith negotiation, then binding arbitration under the rules of the ICC in Brisbane, Queensland.

12. Governing Law
This Agreement is governed by the laws of Queensland, Australia.

13. Entire Agreement
This is the entire agreement between the parties. Amendments must be in writing and signed by both parties.
