By clicking “Buy Now,” “Join the Program,” or any similar phrase on the purchase button, entering your payment information, or otherwise enrolling, electronically, verbally, or otherwise, you (“Client”) agree to be provided with products, programmes, or services by Crystal Austin (“Coach”), acting on behalf of Crystal Austin Nutrition Pty Ltd (“Company”). You are entering into a legally binding agreement (“Agreement”) with the Company, subject to the following terms and conditions:

1. Scope of Services
1.1 Upon execution of this Agreement, the Coach agrees to provide services as outlined in The IBS Accelerator (“Programme”).
1.2 The scope of services is limited to those specified on the Company’s website or Programme materials.
1.3 The Company reserves the right to substitute services of equal or comparable value if necessary due to unforeseen circumstances.

2. Client Responsibilities
2.1 The Client agrees to:

Actively participate in the Programme and complete required work.

Be solely responsible for implementing strategies and achieving outcomes.

Use Programme materials for personal, non-commercial purposes only and not share login details or materials with third parties.

2.2 The Company reserves the right to remove the Client from the Programme without refund for non-compliance with these terms or any disruptive behaviour.

3. Programme Inclusions
The Programme includes:

Access to the IBS Accelerator online portal (valid for 12 months).

Access to the private Facebook group (valid for 12 months).

Monthly 30-minute zoom calls (4 total) with Crystal, IBS Dietitian (valid for 4 months).

Monthly 50-minute zoom calls (4 total) with Jay, IBS therapist (valid for 4 months).

Weekly group coaching calls via Zoom (valid for 4 months). Calls must be scheduled in consecutive weeks from the first welcome call with Crystal.

Bonus materials, including Low FODMAP recipe eBooks, meal plan bundles, expert interviews, and a 3-month subscription to the Nerva Gut Hypnotherapy app.

4. Disclaimers
4.1 The Coach and Therapist are not medical doctors. The Programme is not a substitute for professional medical advice, diagnosis, or treatment.
4.2 The Client acknowledges that any recommendations or strategies provided are implemented at the Client’s own risk. The Coach and IBS Therapist are not liable for any adverse effects or injuries arising from participation in the Programme.

5. Payment and Refund Policy
5.1 Payment:

Full payment is required upon enrolment unless a payment plan is agreed upon.

For payment plans, the Client authorises the Company to charge the provided payment method as per the agreed schedule.

5.2 Non-Payment:

Failure to make timely payments will result in suspension of access to Programme materials and services. If the outstanding balance is not paid within seven (7) days, the Company reserves the right to terminate the Agreement.

5.3 Refunds:

The Programme includes a 60-day money-back guarantee. The Client is not eligible for a refund within the first 60 days; however, they may request a refund equivalent to the final 60 days of the Programme if they have actively participated and have not seen any improvements in their symptoms, as measured by the symptom rating scale (/10) completed at the start of the Programme. Guarantee eligibility requires the Client to:

Submit written notice of dissatisfaction within seven (7) days after the initial 60-day period, but before 70 days.

Provide evidence of no improvement in symptoms based on the symptom rating scale (/10) conducted at the start of the Programme and re-evaluated at the 60-day mark.

Demonstrate full participation in the Programme by submitting completed coursework for Modules 1-4 and evidence of engagement, including attendance records, lifestyle journals, and active involvement in the Facebook group.

Have attended at least 80% of the scheduled calls throughout the first 60 days of the Programme.

Refund requests will be reviewed within 14 days, and if approved, refunds will be processed promptly. Upon refund approval, the Client’s access to the Programme will cease, and all materials must be deleted.

6. Waiver of Liability
6.1 The Client assumes full responsibility for any risks associated with participation in the Programme, including but not limited to physical activities. The Client agrees to consult with a healthcare professional before engaging in any physical activity recommended in the Programme.

7. Use of Note-Taking Software
7.1 The Programme utilises an AI note-taking tool (“Heidi”) during Zoom sessions to enhance documentation. Heidi is HIPAA-compliant, and all data collected is managed in accordance with the Company’s privacy policy. By participating, the Client consents to the use of this tool.

8. Intellectual Property
8.1 All Programme materials are the exclusive property of the Company. The Client is granted a personal, non-transferable licence to use the materials for the duration of the Programme. Unauthorised use, distribution, or reproduction of Programme materials is strictly prohibited.

9. Media Release
9.1 The Client consents to the use of their likeness, voice, and written statements for marketing purposes. The Client waives any right to compensation or approval of such use.

10. Non-Disparagement
10.1 The Client agrees not to engage in any conduct or communication that could be construed as defamatory or harmful to the Company’s reputation.

11. Dispute Resolution
11.1 Any disputes arising under this Agreement will first be resolved through good-faith negotiations. If unresolved, disputes will be submitted to binding arbitration under the rules of the International Court of Arbitration (ICC) in Brisbane, Queensland. The arbitration decision will be final and enforceable in any court of proper jurisdiction.

12. Governing Law
12.1 This Agreement is governed by the laws of Queensland, Australia, without regard to its conflict of law principles.

13. Entire Agreement
13.1 This Agreement constitutes the entire agreement between the parties, superseding all prior agreements and understandings. Amendments must be in writing and signed by both parties.
